It is illegal unless you host the site in China or Russia. But if you live in the USA and the FBI finds out that you own those servers, you are done.
Warez site are not legal, it also depends on the country's rules too , but in general, they are not legal.

Yes they're illegal in most countries only a few islands and russia / china would allow such things to be legal.
