Warez is illegal in most countries. But if you live and host the stuff in a country which doesn't give a damn to these kind of copyright acts, then most probably there wouldn't be any problem. Also your domain registrar should also be the same kind otherwise they would complain the registrar (if it is registered at godaddy, namecheap, register, enom etc) and get it cancelled.
The question is, how are they able to get away with it considering the Digital Millennium Copyright Act?

I agree with that proud. Also in some foreign countries, you can't watch a new hit movie because it is never released in a movie theater or there are no movie theaters and stores dont sell DVD's. How else are people going to enjoy America's great Hollywood productions?

I've never seen ICANN initiate a takedown . The only takedown I have seen are from the web hosts witch are the one's responsible for what they distribute . If the ICANN would be able to do takedowns then we should have no pro terrorist websites .
Host in Russia, China and I think perhaps even Norway and you should be fine. I think you can use Turkey, there are other places but I'm not sure.
this is not a thing you need to worry about when you buy hosting check if they allow to host pirated OK otherwise search for some else in my country i am sure there may be 3 to 5 persons using legal copy of windows Microsoft tried a lot to stop this but failed LOL a judge gave remarks pirated products should be prohibited and a lawyer replied "sir the remarks you are reading printed from a computer which used pirated windows" is that not funny ?
