Are there any good Terms Of Service templates out there for free? I wouldn't mind writing my own but I don't have a clue as to what I should include. Terms of service should reflect what the site is and how it is used. Templates cannot really do that. If you can't afford having an attorney prepare or at least review your TOS, your best bet is to review websites that are very similar to your own and see what they have done. Look at several and pick the terms that seem to be applicable to your site. Just keep in mind several things: The sites you are using to base your TOS on may not have been prepared or reviewed by an attorney. Even if the sites' TOS were good when written, they may have become outdated by changes in statutes, regulations or case law. There may be subtle differences between your site and the others that make certain provisions of their TOS insufficient or inappropriate. There may be laws (such as in California or the EU) that apply to one site and not another. Your best bet is to have an attorney who is experienced in internet legal issues prepare or at least review your TOS.
Ok. I have started to write my terms of services. I have a question though, and I was hoping that since your name is Business Attorney you could answer it. My question is: are there any generic phrases that I should include to make my document legal? I've already said that by using my website they are bound by my terms of services but, I was wondering if I needed to say the state in which my terms of service was made or if there are any other special terms I should include to make it legal.
