Hi, I am in Australia, and whilst I have a generic TOS that comes with my forums, I received a phone call from a Solicitor today asking me to remove a post that was made on my site way back in 2007. I of course deleted it without question and asked the solicitor to verify it was gone from his end and whether there would be further action taken. His response was, his instructions were for me to remove it and that's it, as I am jsut a joe blow person then in his view there is no further action that will be taken. The post was a copy of an article that is now the subject of a defamation case. I am currently not in a position to seek legal advice on what warnings etc and guidelines to put on the forums to protect me (though this is something I will save towards as I dont want more of these cropping up) I am wondering as such whether there are any generic warnings, guidelines, TOS etc that I can place on my site to help somewhat alleviate my chances of having litigation towards me if some loose cannon decides to post something similar in the future? Was it a bad review for a company? Reviews most of the time if they aren't threats aren't seen as illegal unless he wrote the article himself.
no it was something that had been re-posted by a member that was the subject of a defamation case. I have found some TOS that I am using for now that essentially indemnifies me, and am going to have a solicitor read through it too
