Ok, I am in the business of flipping websites and I need some pictures for things such as articles, design, picture pages and I want to get them for free. I heard flickr is a good source. Are these images copyright? Do you have to give the source of who owns them? If so what source?? (eg The flickr webpage, their full name??) Do you have to email them and ask them for permission for EVERY photo you use. Is there any way to just get free photos without copyright?
ALL images are copyrighted one way or another... it's up to the owner/creator of the image what can and can't be done with the image. I use flickr too for getting images, but you HAVE to contact the image owner, tell them what image(s) you want (preferably with URL(s)), Where there images will appear, what will you do with the images (will you edit them?), Abit about your website/article that the image will appear... you don't have to do it like i do, but you will have to ask so that you don't get bitten in the ass with a law suit for not asking...
I think yes they are copyrighted to uploaders and do use them without permission or may be they can sue us in copyright law .
Check out the Creative Commons licenses on the Flickr site - some image owners are happy for ytou to use thier pictures as long as you attribute where you got it from.
Use the search function as you can look specifically for Creative Commons licensed photos... If you do use photos without permission then maybe not tomorrow or the day after, but some time in the coming months of years... expect an email from the copyright holder expressing indignation that you have used their photo without permission... This is a particularly bad practice if you are looking for images for a client's website...
You're lucky if all you get is indignation. I believe in planning for the worst case scenario. Expect notice of a lawsuit. Copyright holders have no obligation to ask you to remove their copyrighted work from your site before they sue you. Also, if you're planning to sell the sites, your setting your buyers up for vicarious liability for copyright infringment and, trust me, if they get sued, you're going to pay for it... Just please make sure that you have a license to use any copyrighted images the way that you want to use them before you post them on sites... Let me know if you have other questions. Look at the license under which it is listed. Again just because somebody claims that the photo is not copyrighted and was made by them does not necessarily imply that the photo was indeed taken by them. If you want permission where all rights are reserved, you will need to ask for it.
If you are making websites to sell you may want to just buy some cheap stockphotos from istock or get free ones from stock x change.
All content is copyright by the person who created the content. They do not necessarily have to register it with a copyright agency, but this does make legal proceedings easier as they can prove it was theirs first. Also note that you do not have to display a copyright notice on copyright protected content. Hope this helps!
On Flickr you can find images to use as follows: 1. Go to the advanced search (http://www.flickr.com/search/advanced/) 2. Enter your keywords and other requirements. 3. * Most Importantly * Scroll down to the bottom of the page and tick the box that says "Only search within Creative Commons-licensed content" AND tick the box that says "Find content to use commercially" That will only turn up results where the copyright holder has explicitly allowed commercial use of their image. Note, however, that that does not necessarily give you permission to resell the image, only to use it yourself. If you want to be completely legal, contact the photographer, explain exactly what you are planning to do, and get permission.
Agree with Nonny, that is what I have done, and used the "attribution" licence. Now...for the attribution. It is not clear how to properly attribute, I prefer not to have a separate entry or title under the photo in my blog, so I have edited the photo tag/title withsomething like.."nameofphoto_CreativeCommonsAttribute_ownerofthephoto" (Flickr username) I am hoping this will be sufficient. It contains name of owner, and that it is licensed thru CC and I am "attributing" it. But it is also "hidden" from view. Any thoughts?
I have some more answer...I found this on the weekend - a search engine for free (Public domain, creative commons licenced) photos. Membership is free and allows you to rate, tag, collect and comment on photos. regards
