i thinking of starting up a website which allows members to earn points in many ways towards Apple products as prizes. Is there any legal information i should know about which would stop me doing this?
Read all of this: http://www.apple.com/legal/trademark/guidelinesfor3rdparties.html In a nutshell: - Don't claim to be "authorised" to distribute their products, and don't claim to be "endorsed" by them - Don't use their trademarked names in your domain - It's all obvious stuff, really Also, make sure you actually send the prizes, otherwise you could get in to legal trouble. Plus CPAlead disallows false claims.
So I can buy their stuff and have it as prizes on my site ? Also would I be against tos to have a domain like iName.com?
Your more likely to run into issues the more you try and make your site appear to be connected to Apple. Remember that large international companies tend to have armies of lawyers on the payroll that do nothing but pursue people for IP rights violations and so it doesnt truly cost them much to take a punt at someone who could be considered to be infringing rights.... where as you you, an IP lawyer for advise is going to cost a lot of money. The only other "concern" from the very limited amount of what you have said is if you are planning some form of pyramid scheme as these are illegal in many different countries now.
