I would like to know what legal issue/precaution I should look out for and know. I am basically hosting a website which will act as a anime directory *Embed anime video*. Most of the content might be copyrighted/DMCA but no content is hosted off my site. We use other source such as veoh/etc. And where would i get proper legal disclaimer , Would i have to hire someone? or is their a certain document I can claim/get/use. as well a Privacy etc. Is their something else i need beside disclaimer/privacy? Am i allowed to: I might include a summary of the episode below the video(the summary might be from another site is that legal? or would i have to give them credit? etc?) Have anime character images/pic/etc on my site? as long as i add reserved rights to the owner? Encrypt the video (anime video from example veoh, so that people cant steal my embed video) ETC. No disclaimer is going to help you if you live in the US. You cannot legally use their content without express permission - no, giving them credit doesn't make it legal. Just embedding the links can get you sued for contributory infringement. If you run adsense, it can also be cause to terminate your account without getting paid.
Ummmm ty, because their was other streaming site (embed video) and seem to have no problem running at all. example www.kumby.com www.zomganime.com www.anilinkz.com and a few other, as for contributory infringement.... ummmm
You can find examples of a lot of illegally operating sites - it doesn't make it legal or give you a defense if they decide to target a site you own. Other sites may have permission to display the content. They may not live in the US. They may not have been caught yet. If you don't live in the US, and host the site in a country that doesn't have contributory infringement laws, you could probably operate a site that embeds videos if you aren't planning on running adsense. Using images you don't have the right to use is something entirely different. A simple DMCA can get your adsense account banned, hosting terminated, and/or your site completely removed from the major search engines. The chances of being sued are probably small - but even if it is only a 1% or 5% chance, you need to decide if it is a risk you want to take.
Well I live in canada, my site is hosted in the US (Justhost), Ummm i spent a fair amount of money investing in my site already.... and i just dont want to quit, As for adsense the worst that can happen is ban my account right? Secondly do you know where or who I can get a reliable legal disclaimer or privacy, or any document that would help decrease my risk of getting sued? and as for picture go to my main page for example: www.ani-view.com I did some photoshop work (text and effect/etc) with a few know anime character... would that be illegal or legal?
If adsense bans you for infringement issues, all that happens is that your account is terminated, you can never have another account - and they don't pay you. A disclaimer isn't going to give you any legal protection as far as copyright or an infringement suit, but you should really consult with a local attorney that deals with intellectual property issues if you are serious about continuing with the site. It might be in your best interest to form an entity that would give you some personal asset protection in the event you are sued. A judgment can follow you for life.
Alright I will keep that in mind, Btw is it legal to copy someone else Legal disclaimer/etc but just change some things (site name/etc in the document). Because i am doing the exact same thing as that site basically or is their i can hire to do it for me? Btw thanks for the fast reply.... No, you aren't legally allowed to copy another disclaimer - but more importantly, laws vary by country (and even by State in the US) so that is why you should really get a local attorney to draft something specific to your site. A lot of people just write their own by reading others and then coming up with something unique - but then they aren't an attorney - and if you ever have problems, that is when you will wish you spent some money.
Do you have any link to template I can use and follow? How much would a attorney cost?, Would I have to meet face to face? I am just a 17 year old lol.
