i came across a very popular tutorial site today... hmm they had that text just side by side with their google ads

    "Please Visit Our Sponsors:

Sponsorship provides financial support for our community."

    hmm against TOS, right?

    Correct - against the TOS.
The obvious inference is that the ads should be clicked to earn cash for the publisher.

If they're a premium publisher they'll probably be okay. Ordinary John Doe on the street, no.

Publishers who bring in oodles and oodles of money for Google. Not too sure on the exact details, but their rules are more flexible.

    Absolutely Against The TOS.
Wait for penalization of the website or disabling his adsense account....

Please show the name of the site. It is interesting that sites can get better terms out of Google. And rewrite their TOS....
