Im in the uk and as im sure alot of you know we love our football I have bought 5 .coms of up and coming footballers names, there not known at all and the players are still only 15/16 but im hopefull at least one will make it big time Now there is obviously a good earning opportunity here What i want to know is where do i stand legal wise if the footballer or his agent want this domain I remember seeing something about waynerooney.com and his layer claimed it was copyright
You wouldn't stand a chance if their lawyer wants the domain back. I don't think this will be an arbitrage opportunity.
That is unless you are a public character, if they become famous they will be public characters and can lay claim to their domains as by then the domains will be valuable assets. Surely you have read about such celebrity domain names being claimed back back by the celebrities themselves.
so they can just claim them back without paying How do you clearly define a "public figure" from a legal point of view thanx for the advice so far
IANAL: Here are some cases, they vary. Madonna.com http://www.wipo.int/amc/en/domains/decisions/html/2000/d2000-0847.html Sting.com http://www.wipo.int/amc/en/domains/decisions/html/2000/d2000-0596.html waynerooney.com http://www.wipo.int/amc/en/domains/decisions/html/2006/d2006-0916.html do your research, if you really need to, talk to a lawyer. John Berryhill Stevan Lieberman Ari Goldberger Paul Keating just to name a few good domain lawyers http://www.dnlist.com/Domain_Names/Legal_Resources/Lawyers/
it should be your that like if i had my name as my domain and somone became famous with the same take it away that not fair
He is suggesting that if he bought his own name .com and someone with the SAME name became famous, it would be unfair for them to take it from him.
if he registered it first and it were his name, it would be hard to say he REGISTERED it in bad faith which is a condition, if he uses it after someone with they same name became famous to put a fan site, he still couldn't have originally registered it in bad faith.
