adult video legality

    I recently came across a bunch of adult videos, as far as i know they were posted online freely by the owner with no terms of use

    I would like to sell them either on a website or to someone that is interested. There not easly found and can be HIGHLY profitable if marketed the correct way

    What would be my best course of action aside from doing nothing.

    You need to contact the person who created the videos for permission to copy and sell them.

    Under US copyright law, copyright is automatic, so the creator doesn't need to put any copyright notice or other terms of service on them.

    I'm under the assumption that it is only illegal to host and sell the videos, but if i don't actually host them and i only link to them i should be fine correct? So if i was to upload them to say rapidshare or some other file host and post the links on my site i shouldn't have to worry about anything.

    I'm sure thats fairly shaky ground as if they send me a letter saying i have to take down the links im sure i would need to. But im also wondering if i was to use a couple of images while making the site would that be illegal aswell

    not to mention age and DMCA - you actually need signatures and I.Ds for proof of age.

    I think you've already made up your mind and you know the answers already .... do whatever you want .... so I don't know why you made this thread ....

    no i haven't made up my mind yet, i was actually seriously thinking of just selling access to the material

    but after the first post i decided that maybe it might not be the best idea so i came up with just linking to them

    im still undecided as to what to do, as i know many warez sites that have been up for years and do the same thing

    the thing is i know there is a TON of money to be made off this material its just how to make that money that's in question

    Regardless of whether they are adult videos, MP3 music, or a still photo. The same copyright issues are applicable to all files. A defense of "fred123" from the DP forums though I'd be OK won't be good enough if they infringe someones copyright

    As has been stated, it does not matter what type of creative material, they are the copyrighted intellectual property of the creator, no ifs ands or buts. Will you get caught and sued? Whos to say, maybe, maybe not. What happens if you get sued? For one, they can sue you for ALL of your profits, any form of damages. Just because he didn't say this is copyrighted, don't steal my stuff, doesn't mean its not copyrighted and you can steal it. Its even worse if your gaining in any way. There was a guy in Texas that got sued by a motor sport company/website because he gave a live feed off their website for an event. But, more than likely, your going to do it anyway, so there really was not reason for you to make this site. It doesn't matter how much money you can make, all that matters is when he decides to he can sue you for everything. And it doesn't matter what other sites do, are you going to base your future on what others do? I know a ton of warez/torrent sites that offer key codes for programs, cracks, etc. Does that mean its not copyright infringement? One day you will get caught doing it, and your going to be hurting afterward.
