Hey, I've started a tube-style porn site, where videos are pulled from other sites. None of the adult videos or anything are owned by me, but I've noticed on other tube-style sites they have a "18 U.S.C. 2257 Record-Keeping Requirements Compliance Statement". Just curious if I will need this, and if so, are there templated statements I can copy and modify, or is there anything else I need to do? Thanks.
First, I think you're going to have a problem taking videos from other sites and using them on your site, since that's copyright infringement. That being said, you couldn't make an 18 USC 2257 statement. Here is a link to the statute. You have no idea whether the girls (or guys) on the videos is of age and consenting to the material being filmed and distributed. You could perhaps state (if you feel that you should have something) that all works are located on websites that display the recordkeeping notices required by 18 USC 2257. Hope that helps. Hey, Copyright infringement shouldn't be a problem as all the sites that the videos are pulled from are sites that allow you to embed there videos on your own site. Thanks for the info about the statement, that clears it up. I think I'll do like you said, display a notice that says all the websites display the record keeping notices. Thanks for the help.
Anytime. Make sure that the websites that you're pulling from assert that they have either the copyright or the license to allow distribution and performance of the videos. Also, you may want to include in your TOS that all videos are the copyright of their respective sites. You should also include a DMCA takedown notice provision in your TOS. Put a disclaimer somewhere stating that you don't store any of the files in your server, that you just link them from other sites. That should help against many legal issues that may arise
I have a question: In my website there are 2 parts: nude pictures (i have a copyright) link to porn pictures or adult site (obviously i haven't copyright) what about 2257?
