Adult rapidshare content from copyright matrial from paysite..

    Hi,

    I'm a new one here, but I've a urgent question for you all. When I have a adult forum and my members posting rapidshare files on my forum with movies from copyright content from adult pay site's. The webmaster from this adult site with his copyright content on rapidshare, must he be mail rapidshare or the webmaster from this forum. Do you have the copyright rules for me or a answer of my question..
    What's the law on linking rapidshare files on a forum ? It's the webmaster responsible for this or rapidshare. please a link with copyrights or answer !! Thank you very much,

    They would have to email rapidshare for each individual file, but this depends on your sites host, if they bow to authorities, any request would probably be fulfilled if only to avoid legal threats.

    He must make a complaint to rapidshare becuse thats where the files are being hosted and they just remove the link and then someone else out there in the wonderful land of cyber space reuploads it and post it again

    If a porn industry also finds your porn forum offering to much of there material they could complain to your ISP and request you shut it down.

    But most like not, they will probably contact RS.

    They'll probably just go to RS first.

    To protect yourself, you should revise your forum's TOS to protect your forum just in case an infringment issue arises.

    They could possibly hold you (your site) responsible for contributory infringement since you are facilitating the infringement of the copyrighted material by linking to them.

    Rapidshares problem 100%. Do what i do, get an offshore server that does not bow to corporate America or respect DMCA notices, because is not their law, way outside the jurisdiction, etc etc, so to speak. I once had a server based in Iran, i cant see MPAA officials getting access to that server anytime soon.
