2257 is only for producers of the content. If you are a distributer or re-distributer than you have no obligation to keep the 2257 record, however i would stipulate somewhere on the site that they are over 18. I also run a Thong website, generates ok money, but can be rather costly when starting up. My site gets 4000 - 11000 uniques per day and is now 2 months and 2 days old!
you don't have to keep the 2257 records in your office (or bedroom) if you are not the producer of the content. but you do have to inform on your site that there is 2257 records available for the models from the origional producers. But if your not american you don't even need to worry about the 2257 law. its not an international law.
You can charge whatever you want (even a million bucks) for providing the service... as in providing download links and server maintenance and so on. I doubt you need to make sure of any US law, get hosted by me and you are safe (offshore). PM me
You say that provide a link is different. Let me ask you this, if I host the pictures in some free hosting service like shareavenue or imageshack, and then post a thumbnail and link in my site, can they do anything against my site?
Copyright law gives the copyright holder exclusive rights to display works publicly excluding fair use exemptions. What I was refering to is 'deep-linking'. It's a controversal copyright topic that I don't believe has every been decided in a U.S. court -- the cases all reached settlement, I believe. Basically, copyright holders argue that by deep-linking their exclusive right to display and in what order to display it is violated. In addition, income is lost by bypassing ads on the homepage to get to the content. In Germany deep-linking is legal. It's most interesting to think that anyone could consider that hyper-linking to any web page can be illegal. Now if it was "hot linking" to media to display it on a different web site, one that is not related or does not own the media then yes that could be illegal. But it's very easy to prevent offsite linking and any webmaster concerned about such a thing can easily take control of the situation. And if it's not protected I would assume that it's not an issue for them.
Nope. This isn't quite right. The law defines "produces" very broadly. It could just mean uploading an image to a site. The full text was already posted in this thread, just look it up.
