Adsense sidebar ad is floating... IS THIS FINE/ALLOWED?

Hi guys, one of my ads on the sidebar floats when you scroll down the page/up the page like 9gag.com, I was wondering if this is fine, with adsense or could this be against their TOS? The thing is, I have a lot of content on sidebar along with the ad, so when you scroll down the page, you don't really see the ad, but anyway, IT FLOATS..

yes, no, it doesn't matter what people say, you need an official answer about this, from adsense. And let us know please when you get a clear answer, I hope DP will still be online by then.

I don't think it's against the TOS, if 9gag is using it I think for sure it's allowed. 9gag has millions of viewers and it's almost impossible for them to risque getting banned.
In fact there's a new type of ads that pops up from the sidebar which it's kind of weird coming from AdSense and you have to close it to get rid of it. A new way to draw people attention after they got ads blind.
But hey it wouldn't hurt if you ask for an official answer just to be 100% sure.
