Adsense Affiliate Wage Garnishment

    I have a close friend that is going through a civil case and he has many websites running with adsense and affiliate income. This is not his sole income and he is worried that his "wages" from adsense and affiliate income would be garnished if the case is not found in his favor. He is ready to pull this income from his sites and maybe sell them if there is a judgment against him. I'm ready to buy them from him if he decides to do this. Should he really be concerned with having to give up that income if there is a judgment? How would Google Inc. handle such a case, would they be obligated to garnish his wages? Same with the affiliate programs? Just trying to help him figure this stuff out.

    depends if they are aware of his online earnings?
    If they know of them already then there is a good chance it will be included.

    Don't you have to supply google with your Tax Payer ID? This means that Uncle Sam will know about the income. And if he sells it after the judgement and they find out he was trying to hide it from the court, he could be in some big trouble.

    It is a civil case...They might not now about his online income eventhough you do have to supply you EIN or SSN to google whenever you register. If they ask you about your sources of income I would mention it. If they dont ask about it, I would keep quiet. I might be mistaken but a lot of times in civil cases they would not have resources to check it all out. I know couple of people who won civil cases and where trying to get their money out through those judgements, and let me tell you it is not as easy as it seems at first. I would not give up online income. In a worst case scenario it's better to loose half of it then the whole thing anyways. Plus if judgement is placed then you will have to pay it out anyways why not let your money making online business pay for it. ;)

    They will garnish this, especially if this is a substancial portion of his income. Google will gladly cooperate with the courts

    You sound so positive, are you a lawyer? Legally I do not believe Uncle Sam or Google, Inc. are in the situation to garnish funds from an adsense account.

    For garnishment to occur on an adsense account the person would have to own a business and pay wages to himself.

    "Wage garnishment is a legal procedure in which a person’s earnings are required by court order to be withheld by an employer for the payment of a debt such as child support." U.S. Department of Labor

    Google, Inc. cannot garnish them unless he is an employee of Google, Inc. which he is not.
