Adsense Account Disabled Coz of DMCA Violation

    Dear DP Members

    I have 2 blogs - one related to technology & the other related to the sport - cricket, a couple of weeks ago - i received a mail from the Adsense support team citing that Ad serving on my account was disabled.

    Google has been notified, according to the terms of the Digital Millennium
    Copyright Act (DMCA), that some of your webpages allegedly infringe upon
    the copyrights of others. The notice that we received is attached to this
    e-mail. Please note that we have disabled ad-serving to the URLs of the
    allegedly infringing webpages, which may be found at the end of this
    message.The DMCA is a United States copyright law that provides guidelines for
    online service provider safe harbor in case of copyright infringement. If
    we do not receive a counter-notification from you within 10 days,

    And they also mentioned this - Google can restore ad-serving to the affected URLs upon receipt of a
    proper counter notification pursuant to sections 512(g)(2) and 3) of the
    DMCA.


    But alas, since i could not check my email for this message, after the initial 10 days, the ad serving on my site was disabled & when i logged into my adsense account to check my earnings - it showed me a warning stating that my account was disabled & i rushed to check my mail where i found the above message + another reminder sent on 13th April, 2010 from Google Adsense Support Team citing this -

    Hello,

    Previously, we let you know that Google was notified that according to the
    terms of the Digital Millennium Copyright Act (DMCA), that some of your
    webpages allegedly infringe upon the copyrights of others.

    The DMCA is a United States copyright law that provides guidelines for
    online service provider safe harbor in case of copyright infringement.
    Since we did not receive a counter-notification from you within 10 days,
    we have disabled your AdSense account at this time.

    Google can keep you as an AdSense publisher if you send a proper counter
    notification pursuant to sections 512(g)(2) and 3) of the DMCA. For more
    information about the requirements of a counter notification, and a link
    to a sample counter notification, see
    http://www.google.com/adsense_dmca.html.


    To expedite our ability to process your counter notification, please use
    the following format (including section numbers):

    1. Identify the specific URLs of material that Google has removed or to
    which Google has disabled access. For Google Groups, identify the sender,
    date, newsgroup, and subject matter of all the material in question.

    2. Provide your name, address, telephone number, email address, and a
    statement that you consent to the jurisdiction of Federal District Court
    for the judicial district in which your address is located (or Santa Clara
    County, California if your address is outside of the United States), and
    that you will accept service of process from the person who provided
    notification under subsection (c)(1)(C) or an agent of such person.

    3. Include the following statement: "I swear, under penalty of perjury,
    that I have a good faith belief that each search result or message
    identified above was removed or disabled as a result of a mistake or
    misidentification of the material to be removed or disabled, or that the
    material identified by the complainant has been removed or disabled at the
    URL identified and will no longer be shown."

    I immediately logged on to www.google.com/adsense_dmca.html on the 14th of April & filled in the Counter Notification Online since it was mentioned that Submitting a counter notice online ensures the quickest handling and processing of your request..

    I also received an acknowledgment for the same in my email -

    Thank you for using our online counter-notification form. We have received
    your counter-notice and have queued it for review. Once our investigation
    of your notice is complete, we will send you an email confirmation. Please
    note that we receive a high volume of notices and address them in the
    order they are received. We appreciate your patience.


    My Question is this - Today it's the 20th of April & still I haven't heard anything from the Adsense Support Team, Does this mean that my account is banned forever??? & what about my earnings for the month of March? will i be sent a cheque for that?

    Or should i wait for a few more days & wait for their response??? Will i get my Adsense Account back, since i have removed all the URLS from my site which were found to be violating the terms & conditions & also have filed a Counter Notification.

    I also facing exactly the same problem as your problem. My account was disabled.
    i have sent a DMCA Counter Form last 2 weeks ago, and Google haven't reply/response me until now.
    (it says will be reply within 24hours)

    I have balance around $300 in my adsense, but suddenly my account disable, and it looks Google don't care about my situation.
    GOOGLE just only have One Way Communication.
    Hi guys, do you know how to contact Google about this? (please don't say to read the FAQ or submit to the Forum, It's USELESS!)

    Well you can use their support help form. But I will suggest you to wait for some more weeks. Keep on checking your mail and adsense account regularly.
    DMCA is a big problem and every site face it.

    Earlier I had filed the DMCA Counter Notification Online, but yesterday i even faxed it to the Google Adsense Support Team...i Guess that worked maybe coz today morning infact right now when i checked my blogs - I was delighted to see Adsense Ads live on my blogs, i quickly logged on to my AdSense account & to my surprise found that It was indeed active & Google had also sent me the payment for march yesterday.

    I am so delighted to be enrolled back into the program, & i wish to take care & adhere to all policies & make sure It doesnt happen again.

    Dear members my sincere advice would be to log a Counter Notification online + also send it via Fax maybe it can help you all to in getting your Adsense Accounts Reinstated quickly in case if you've received a DMCA Warning & your account is blocked coz of it

    Did you have copyrighted material on your blog? If you did, they banned you for good reason. That's someone else's work, and not yours.

    Well, Never try to Copy content or even an image from other sites if they are copy protected..!

    Remove those posts and your account will be reinstated as you said..! :D

    Well, Give google some more time...! Its Waiting better than loosing the money :)

    Thanks for your replies, but as i mentioned in my earlier reply, i had mentioned that i removed the violated content immediately & as a result Got Reinstated back into AdSense yesterday after i had sent them the Counter Notification via Online + fax

    Not only that but Google also has dispatched the cheque for last month's earning's as well.

    I am Lucky---Thanks Google AdSense Team, i will make sure not to repeat this mistake ever again & thanks to all members who replied to me on this thread

    Did they tell you which page that violated the DMCA or you have to guessing it by yourself? this is a new experience and story for me. Thank you for sharing. :D

    Hi williammfelix - When Google Adsense team had sent me the 1st notice about the DMCA violation - they had included the URL of the infringing webpage in the email - that's how i was able to identify that page & removed it straight away & submitted the Counter Notification.

    Hi ardianbudi,
    I found that you can re-enable your Ad-Serving. I have the same to your problem but I cannot solve it yet.

    I removed the content which was infringed the copyright of other. Could you advise me how to write the counter-notification and how to send to google adsense team? Appreciate for your help.
