Ads next to images, is this example allowed ? ADVICE and Help please :)

I know ads next to images are tricky and not allowed, as adsense state here

my question is this example OK ots its against the TOS ??
see the attached image.




also i noticed some photos, wallpaper sites show ads next to images, like this :

this is a little pushing. there supposed to be a clear dividing line between ads and images which i dont see.

 

I think its ok . Unless its directed toward ads
