Actions against blogger for publishing contents related to my domain

Discussion in 'Legal Issues' started by iitt2007, Feb 16, 2010.

    A person, owning a blog with the same niche published something irrerlevant (and not true) about the domain I owned.
    Google search gets his page, on the top of my domain, affecting the visitors.
    I tried to talk to the owner of the blog to remove the posting (containing name of the domain I own) or post the correct information, with no luck.
    He doesn't have any of my domains live links in his blog though.
    What are my other choices, to get his post removed?
    Thanks

    Buy him out, threaten violence, carry out said violence, hire a lawyer to initiate an unfounded lawsuit in the hope that he caves, tell his mommy, destroy the server it is hosted on...

    I really think that covers all the options you have to get is post removed. However, my suggestion is none of the above--just suck it up.

    People are entitled to their opinion. Instead of trying to be the "I'm going to take you out guy" try to figure out who it is and what happened to him. If you are scamming people then he has every right, but if you are a good seller most of the time then try to figure out what you did to piss him off.

    If in fact he is a competitor. Destroy him, but do it respectably anything you do reflects your business.

    As a practical matter, other than extremely costly, possibly international legal action, you have no way to force him to do anything. Either try to talk him down, or just ignore it. Make your own site better, more people will link to it, and this person's blog will move down in the ranks.

    I'd say your best options are:

    1. Hire a lawyer for a possible defamation case, assuming what the person said is false and you can prove it hurt your business (and that you have lots of spare cash to pay for this.)

    2. Ignore it, because it's bound to happen all the time. The internet is full of trolls. The more success you find, the more trolls will follow you.

    You can discuss with him pay some money or advertise on the same page using adwords .settle down... And check whether his complaint is genuine and try to improve your service.Or in comment section provide the justification for his complaints

    You can report that blog for abuse...

    But as per blogger TOS below policy is applicable....

    The above post is the way to go, but your thread's title is wrong.

    You are wanting to do something against a Blogger's user, not against Blogger, which is a service that ultimately is not responsible of what its users post, but can remove offenders :rolleyes:

    Honestly, I dont think that anything can be done about this post. He has used the word "scam" in the content, but that is due to the T&C's being read to late (?). Its a review and taking it on the chin seems the best thing to do.

    If you attempted to do anything it could cause even more backlash from more people commenting and giving the site more ammo

    The only options I would say you have, is:

    1) Try to reason with them. Contact them via any available means they offer. On the footer, they offer you a gmail address, and alternatively to that, you can comment on their post in an attempt to show your side of the story

    2) Ignore this, and focus on building your services reputation, and out SEO his page so that you appear above his page in the search engines, in order to minimise damage to visits

    What about his review is inaccurate? It seems as though his beef is with the affiliate offers you have on there.

    Doing business by cheating common man, Would you support such business or stop them doing so.

    Sorry for writing big comment, may be it will take some time to read all, but I suggest the community members to read it.

    I don’t have any personal intention to hurt anybody or their business.

    We have the blog http://freevcalls.blogspot.com , and write offers about free calls and cheap calls, independent of the company. If we find some companies offering free calls or cheap calls, we write it on our blog. We don’t charge anything to write about these offers. however we promote brands with good affiliate program.

    About the complaint by mufphone owner

    The owner of muftphone has another domain called ideaindiacall, and we have written a good articles FREE OF COST and also helped him to test the service with no charge.

    Once they got the good customer base, they started sending the following emails to their customers

    ===
    Seasons Greetings from IDEAIndiaCall.com.
    Fill in a short survey at http://www.ideaindiacall.com/promotions.html and get up to 3 hours of FREE phone calls to the world (includingIndia) from USA/Canada. Once survey is complete, email containing PIN will sent.
    Thanks
    IDEAIndiaCall.com
    ====

    This was a Big scam, as the user has to complete the CPA lead survey, where he pays between $5-$10 and receives a PIN for 2-3 hours of calls worth $2-$3.
    I know this CPAlead program pay $5 to US affiliates. I think Ideaindicall made some money out of it without clearly indicating terms and conditions on the website and got the idea of launching muftphone.

    I discussed with the owner and told him to stop this, moreover I did not write any review as he promised me that he will stop it and come up with a new plan of free calls.

    After sometimes, I received this mail from the owner (again trying to fool the customers)
    ==
    Hi XXXX,
    This is XXX. We talked earlier about IDEAIndiaCall.com. Recently I am testing http://muftphone.com. This is based on CPALead and has very different business model. Users can make 10 mins free calls every 60 mins. If they fill in survey they will receive 2 hrs phone card.
    muftphone is not at all related to ideaindiacall.com.Just using their services.
    I will appreciate if you could publish a review on your blog. If you wish I can arrange (exclusive for you) a big banner on the top (for your blog) on muftphone.com
    Thanks
    ==

    After this we had few emails exchanges as the service was not working, and the main intention of the muftphone was to redirect readers to take part in the survey and loose money because of CPA lead, moreover muftphone earn bucks looting the customers because as per the terms and conditions the customers can’t do anything if they participated the CPA lead survey.

    Now see how they are advertising on the blogs and forums, I found the same comments on many voip blogs.

    ==
    Thanks for the woderful information. I always visit your blog to get the various offers by VOIP companies. I usally call my family in India. While browsing, I found an interesting site, which lets you make unlimited long distance calls from USA/Canada to India and rest of the world, using your phone. This is not PC to phone call. You don’t have to download anything or need any internet connection. I really mean unlimited. The catch is each hour you can make 10 mins free call to India (or rest of the world) and then come back to get another PIN . I even called my friends in UK and France, voice quality was okay.
    Visit http://www.muftphone.com to make free calls. I also filled a short sponsored survey, and I received PIN to make 2 hours of phone calls.
    Friends, just wanted to share this information with you. I am not working or have any affiliation with the said waebsite.

    Can you see the clear intension of the muftphone?? I would say it as a SCAM, what is your opinion about it?

    I agree with most of the comments, rather then focusing on my review, he needs to focus on the service so that more websites link his site and it comes on top.

    Now you try the free calls at muftphone.com

    Now you read my review at
    http://freevcalls.blogspot.com/2010/02/muftphonecom-scam-never-try-cheating.html

    I hope you will come to know my clear intension. We are not business rivals of muftphone, nor we are paid by the rivals of muftphone.

    So far, I have not received any request from muftphone to remove the post. However, if the members of this community recommend me to remove the post. I will do that for free of cost.

    Thanks for your time and opinion.

    I feel it is correct to make people aware if they are really loosing money in this way...

    But if muftfone is asking to fill free surveys then it could be fine.

    I hope you disclosed this information (scam) with good intention.

    if the information is correct then no need to compromise for any money or any other greed and let it be.

    Thanks for the clarification and emails.
    I am the owner of muftphone.com.

    Muftphone had two options,
    1/ free '10 minute calls'(without CPALead), user must wait for one hour for another call. User can call unlimited, at any given day (restricted to 1000- @10 min free calls per day)
    2/ If user doesn't want to wait, he needs to fill in CPALead survey and, once survey is complete, user gets a calling card worth 2 hours of long distance talk time.

    A couple days after the lunch of muftphone, option (2) was removed. Users can still use option (1).

    There are pretty positive reviews about the services (google for "muftphone") on various other blogs and various users.
    In fact on the freevcalls blog, one of the published review is :
    "I tried this service and I did make calls to Pakistan (1st try wasted 2nd try success). I did not see the 2 hours of free calls? Wher r they? But I think the servis is good."
    I know freevcalls. freevcalls had published good reviews (free of charge) about the other domains I owned.
    In the above note :
    "So far, I have not received any request from muftphone to remove the post. However, if the members of this community recommend me to remove the post. I will do that for free of cost."
    I didn't ask freevcalls to remove the post, as I always find good criticism is good for improvements (Option (2), with CPALead was removed), but I will urge freevcalls to make appropriate changes, in his posted review, to reflect the truth.
    I will humbly ask DP members to visit :
    www.muftphone.com and the review
    freevcalls.blogspot.com/2010/02/muftphonecom-scam-never-try-cheating.html
    and let me and freevcalls know your views about the posted review.
    DP members, thanks you in anticipation for your time. Thank you freevcalls.
