So I worked at Burger King and quit because of all the crap there was. However, my friend did not and continued working there. Recently a cash draw was $1,300 was stolen from the draw. Now the managers accused him with no evidence accept that he was given the draw and told it was his. The thing is the draw could have been opened by ANYONE who works there. So Burger King called the cops on him and they told him he either had to pay back the money or take them to court. He paid them back but could he take them to court now and have a decent case? SOMEONE PLEASE GIVE ME SOMETHING TO GO ON?!?!? I plan on defending him for free but I need something besides they have no physical evidence. Is that enough?
I'd think that all you would have to prove is that other people had access to the money. That creates doubt. You don't have to prove he didn't take the money, they have to prove he did. Being responsible for the drawer is one thing, but how can you hold one person responsible and at the same time allow others access that are not responsible? Now, he could lose his job either way, but having to pay back the money or face criminal charges shouldn't apply to him (in my opinion).
I think you should consult a lawyer and tell them about it. I personally think if "more than one person" had access to the money, then it's quiet possible to prove that others indeed, could have taken the money. Basically you need to show your friend was innocent. The way I see it, the issue may never be resolved, unless there were witnesses, whom saw the stealer...
