I'm not sure of the legal aspect. . . But his websites nameservers point to: www.websitewizard.com Maybe that's his hosting company? If that's the case, at the very least you may be able to get them to remove your content from his website. As far as copyright, I am nearly certain that once you've created a work that you have copyright to it, only creating it without credible proof that you are indeed the creator would likely keep you from receiving damages. I know in the US it's often stated that writers/musicians/etc (I've even seen this stated by someone from the UK) can create a CD (or some digital/hardcopy form) of copyright protected work & mail it to themselves through postal mail. The unopened copy of the protected work would then serve as "proof" of creation. I do not have any legal/copyright law background. The information I have shared is something that I have read time & time again on forums & even offline publications, though I can't say from personal experience.
Well, if the videos are of him that's at least somewhat credible proof... not to mention that his clients could back up that they're in the videos as well, and that it wasn't authorized to be used by this competitor. But yes, you do own copyright once it's created. The Poor Man's copyright won't likely hold up. Just contact the host for now and get it removed as soon as possible by sending a dmca notice. If they're showing up in search results, you can have them removed from the major search engines easily enough as well by following their dmca notice guidelines. If there are advertisers on the site, you can also contact them. And if the video's hosted on YouTube, and just being embedded in their site, I'd start by pulling that video off YouTube, reuploading it with another filename, and not making it embeddable by other users.
very good advice. Once somebody stole my videos and to make matters worse they watermarked those videos with their logo. Sent them 2 notices hey just ignored.
