At the moment I am in a dispute over the service of a company. I have a premium acount at www.esportsea.com . This company provides a service for people who play a video game called counter-strike. To begin they have no terms of service or anything of that sort before you pruchase an account. So my problem is they ban me for leave a server in the game to many times. I can not control this leaving of the game due to my connection on campus which boots me from the game servers. They wish to neither revoke the ban nor refund me the money even though they never state that they wont do either of these. They do not have anywhere before purchasing an account have a terms of service, rules or some sort of contract which outlines the rules and regulations of the company and it's clients. I want to know if I have any legal case because they are being biased because of a person's connection or because they do not have a terms of agreement page before purchasing the program.
They have the users download a client which regulates everything so i do not see how this is a mirc problem and I am very serious about this. But my concern is they are willing to way problems such as weather, power outages, and other disconnects that are out of a persons hand and will not do it for my case. My case is I go to a school and they "mess" with the connection. When my school "messes" with my connection I can get dropped from a server. Since this is out of my hands couldn't it be considered biased that they will allow the other disconencts to be revoked and not mine? Also they do not make rules, a term of agreement, or anything along those lines very clear or alert the public about these things before purchasing the account. I bascially go to complain to them and they tell me it is their policy to not give refunds but they do not make these policies very public.
They can tell their policy to the judge. I don't know the full situation with you or the company you claim you have a dispute with, but the "it's our company policy" excuse is a frequently used rationalization to ignore legal responsibility. I went to the site and didn't see any terms of service. You may want to point this out to them and demand that they either return your money for the unused portion of the service.
I can't imagine the amount of money here is large either... It's difficult to say "get a life" and move on these days regarding online games. At my business that could mean joining Habbo Hotel and spending endless hours there (which is not what I understand as "getting a life" lol)
Unless you're as good as Team 3D or WEW, it's not worth investing too much time into it. I wasted countless years of my life doing it and I'm so glad I don't do it anymore.
