Hi fej, sorry about what happened again. I'm new at DP but I know that protection is always needed in case of incidents like these. It's your prerogative to do what you think is best -- an illicit act has been committed and it's in your rights to do so. If anything else, I just wish you well on your next contest endeavors (don't forget the watermark).
Two contest?! He also has another contest?! Damn! Is there any way we can make these kind of people suffer?! Perhaps we can strike at the heart! Look at what he even said mates: This will be a logo contest for my website Niggaspot.com. The current logo which I made, as you can see Sucks! --> claiming that he designed the logo and that it sucks! Question is: does he even have the skill to make a logo!?!? haha
I've sent a PM to the contest holder. I will give him a couple of days to answer and if not, he will be banned. Why are you people not watermarking your images?! Hopefully you have learned a lesson, if nothing else...
I think he just replaced the image file, so it was showing up in the old one's place. I don't think he was claiming to have designed the one you made. Still, poor display from him.
Yeah, we should all practice good discretion next time... otherwise those cheaters will keep repeating the same process, opening new fraud contest just to cheat someone.
Thanks VS. you're heaven sent! Yeah i agree that he has just changed the image file. But now, it just appears that he was the one who designed it. anyway, lesson learned! Watermark is every designer's bestfriend! Oh man! I just saw another contest posted by this freak! Check it out: http://forums.digitalpoint.com/showthread.php?t=321686
I'm not sure if this is against the rules as it is public information that can benefit us. http://whois.domaintools.com/niggaspot.com If you would like to give this abby a call
what a cheater!!! atleast yo know Fej that he like your design but he just cant pay the 101$ coz he's site is not even earning a cent! loser!
Just because you don't watermark does not mean he can take and use your work. If you are serious about it, send him a cease and desist letter. I took this one of the net http://www.utsystem.edu/OGC/INTELLECTUALPROPERTY/contract/cease.htm: Dear [name]: It has come to my attention that you have made an unauthorized use of my copyrighted work entitled [name of work] (the "Work") in the preparation of a work derived therefrom. I have reserved all rights in the Work, first published in [date], [and have registered copyright therein]. Your work entitled [name of infringing work] is essentially identical to the Work and clearly used the Work as its basis. [Give a few examples that illustrate direct copying.] As you neither asked for nor received permission to use the Work as the basis for [name of infringing work] nor to make or distribute copies, including electronic copies, of same, I believe you have willfully infringed my rights under 17 U.S.C. Section 101 et seq. and could be liable for statutory damages as high as $150,000 as set forth in Section 504(c)(2) therein. I demand that you immediately cease the use and distribution of all infringing works derived from the Work, and all copies, including electronic copies, of same, that you deliver to me, if applicable, all unused, undistributed copies of same, or destroy such copies immediately and that you desist from this or any other infringement of my rights in the future. If I have not received an affirmative response from you by [date give them about 2 weeks] indicating that you have fully complied with these requirements, I shall take further action against you. Very truly yours,
Try this: 1. Send a cease and desist letter. (mentioned by xpressions) Look up the law and letter format here: http://en.wikipedia.org/wiki/Digital_Millennium_Copyright_Act 2. Send an e-mail to their webhost and ask them to take down the copyright image, i'm sure webhosts have strict rules on that. Look up their site here: http://www.dnsstuff.com/ (Don't abuse it though) Seems that HostGator is their host: HostGator Terms of service: "...Use of our services to infringe upon any copyright or trademark is prohibited...." http://www.hostgator.com/tos.shtml CONTACT: http://www.hostgator.com/contact.shtml NOTE: blah i'm just reposting some stuff already said, just noticed, sorry.
Looks like something "happened" to his website : "Fatal error: sql: "SELECT val FROM sys_sett WHERE code="site_name"", error: "Can't find file: './niggaspo_niggaspots/sys_sett.frm' (errno: 13)" in /home/niggaspo/public_html/include/classes/Object.class.php on line 63" http://www.niggaspot.com/ I guess ripping off someone in a webmaster forum, is not the best idea if you want to keep your website up and running...
