    To be honest blaming vB isnt the best thing to do...Without vB forums will be shit..

    Hope no one from vBfaq or vB.org is here....vB is the only script or software which i have used and found no bugs...

    They dont release before testing a lot...Dont blame without any info..Mods should just close this thread...No one has any info and the blaming game is going on

    Yeah i think this is basically eBay sending a message to everyone in the EPN that hey.. we know some of you are using blackhat.. we will catch you etc.. dont do it.. I doubt whether they expect to get too much money from these guys.. more about the message it sends.. as they were already willing to pay affiliates a commission so they did not lose out on any money in reality they were'nt willing to pay..

    I read the whole of the document there. It's pretty bad. They are seeking damages, and also the right to have Shawn Hogan removed from any connection to EPN.

    The claims also state that Commission Junction phoned Shawn up and asked about suspicious activity. He apparently told them it was a bug in his code and was now resolved.

    They also claim he wrote software that stuffed cookies. The other guys apparently used hidden images and javascript to try and hide it.

    As to the references of deception, apparently cookies were only stuffed to those users browsing the web outside of San Jose, USA, so to prevent Ebay employees from being stuffed and detecting activity.

    It's all pretty heavy. I do hope Shawn will come out of it OK. I am sure he has a brilliant lawyer though.

    This is pretty bad for DP - I hope Shawn get's what he deserves one way or another (innocent until proven guilty!). I'm sure if he is innocent that it will come out in the end.

    Yes, they CAN say anything (unless the judge imposes a Gag Order but that would be after the trial has started) but they are pretty stupid if they do. Especially if its posted in a public forum where "anything you say can and will be used against you in a court of law." :p

    Heck, if it's on DP then it's gotta be true! Right? :rolleyes:

    My guess would be about 17 cents so far... :rolleyes:

    This is a civil case. I expect Shawn and the other defendants will file a response within the time allowed. I believe it is around 30 days from when they were served with notice of the lawsuit against them.

    The response will do one of two things. It will lay out the defenses known at this time or will attack the complaint on procedural grounds.

    I have read many, many legal cases. When they have good lawyers, I often find myself agreeing with whatever document I am reading. I read the complaint and it makes sense and I think "that makes sense"... and then I read the response and I think "oh, that makes sense". Cases are rarely black and white with one sides contentions or allegations totally correct.

    In cases dealing with some areas of complexity, there is also a good chance that what the plaintiff thought was happened was something else entirely. Many times lawsuits are instituted as a way to find out what it really happening. There is a period, aptly named discovery, where each side will be able to ask questions of the other and demand documents which will help everyone understand what truly took place. Only the parties will be privy to that information unless it is used as evidence in an eventual trial.
