for me i have copyright certificate signed by a Notary Public that can be used as evidence.

 

Without getting involved, a notary public certificate just means that the person who signed a document is that person. It isn't evidence.

As an FYI, the Internet Archive waybackmachine says that this design was on the Neosurge web site back in 2005. I remembered it well because I was speaking to the designer a few years ago for an important site of mine.

If you got your web site template last year in 2007, then you should probably be asking your web site designer what's going on since this design was custom designed in 2005. Best of luck to both of you.

You don't need to officially file a copyright with an IP office. Once someone has created it, it's theirs although proof can become an issue. Oddly enough, I just decided to search here and found the following item below, where you were apparently notified by another user several months ago that your allegedly purchased template still had links to the neosurge.com site's customer support!

the support link didn't show neosurge and when i asked neosurge after ripified post. i have contacted neosurge support and employer say to me is a purchased templates also my designer don't sell this templates anymore. (Asked yesterday)

We are now the only one company with the legits right into this templates.


and finally he never respond to any mail and the "owner" if he as. don't respond also.

Neosurge site have 7 page.
and mine 21 files.

now this morning my business lawyer send a copy of the copyright for the website.

Neosurge commissioned a professional designer to make the design from scratch. You admin his design predates yours at Underhost. You have no legit rights at all in the templates.

One can clearly see that the design on Underhost is a rip. Just compare the images that mention the pricing (Web Hosting from "1.35$/mo") and look how weird the one's on the Underhost home page look.

Also, the colocation button on the underhost site just links to their VPS page - http://underhost.us/vpsindex.html . Did you forget to rename the button ?

Wow, you still use html for all your page? Well, not a big deal but one noticeable defect on underhost is that your pricing is like was made using Paint. So, whoever sold you the template was ripping it from neosurge. Well, it is not our rights to decide on this though, I just want to wish you both luck and hope you guys can settle this off nicely for the sake of your business reputation.
