You will not find a host that fits this description - no matter what they promise. You say that if your site is offline for one second you will be jailed? What do you mean? Is there an authority who is monitoring your site, waiting for it to go offline so they can put you in jail?

Most hosts offer a 99.9% uptime guarantee, but even if your site is only down .1% that would come out to more than 40 minutes of downtime per month.

If it is as you describe, one second off line and you go to jail, one server is not enough, you need a minimum of 2 servers and a load balancer, the two servers must be better in separate geographical locations. Best of all the load balancer has some redundancy, two load balancers would be better......

This must be some really important content that you can't have at most 40 minutes in a month downtime.

forget talking about getting jailed. as interesting as this point maybe, as dawinters has said, get two servers and when one goes down, the other wll be ok...
apply this as a principal- backup.

There is no such a thing as a "best host". I might have an excellent experience with one host while you might consider them a nightmare.

You need to explain to your client that a couple of minutes downtime is actually a good thing for your website (such as for rebooting the server, maintenance etc.). Only that you will have to give some limits to it (for instance you guarantee 99% uptime etc.). If he doesn't even have a site by now then I guess he won't be going out of business because of a few minutes downtime.

You should change the clauses of your contract with this customer. Who would go to jail in case of downtime? Perfect nonsense

(Or charge him $10,000 a month and offer yourself a minicluster, and you will have 100% uptime, even if half of your servers go down for no known reason)

Personally, I use Dreamhost, they offer an excellent service and I pay $7.95 a month.

I think the lawyer will understand the situation if you explain it.
The downtime is due to server reboot
