Buying a site and/or domain - Legal Issues

    Hi all, I am looking at buying and selling sites and domains at some stage in the near future, but before I start doing this I wanted to discuss with you guys about any legal issues related to buying/selling sites or domains.

    If I am the seller, what's the best way for me to go about the sale. I want to make it clear to the seller (contractually) that I will not be liable for any costs after the sale date. Ex: Site mantainance, hosting fee, reg. fee etc. I also want to clarify that the site is being sold as is where is and if any bugs are discovered at a later stage I am not responsible for getting these fixed.

    As a buyer, I would like to clarify exactly what the running costs are and whether there is any money owing on the site/domain (if that's possible). I also want to know whether the site is obligated to link to certain sites for a certain period of time (ex: when buying a directory). I would also like to know whether the previous webmaster has purchased any links/advertising/PPC which is producing the traffic. I would also want traffic stats and revenue stats. Is there any way of verifying this data? Ex: If someone says they earn $200 a month from Adsense (Say), how can I verify if this is correct?

    Also, with domains: How do I move a new domain I buy under my GoDaddy account. Is this possible. At the moment, I can see all my domains under my GoDaddy account. Can I add new domains purchased from someone to this list as well??

    I would suggest you try moving a domain from another registrar into and out of GoDaddy. Based on my experience you will quickly decide you need a different registrar :)

    If your buyer has a Godaddy account(he will), then just push the domain into his account. You can see that in account change menu.

    You can check old post which is about "domain sale or website sale". And you should read all posts carefuly because old topics include really good information for us.
