Here in California its not even an issue any more. That's because the voters passed Proposition 215, which legalized medicinal use of cannabis. Someone with a legal document allowing them to use the stuff, wouldn't be penalized, would they?
Actually, according to State law it's legal, but under Federal law it's not, and Federal law trumps State law (but I don't know too much about the US legal system). I recently saw the film Super High Me in which a comedian stays stone sober for 30 days and then high every minute of the day for 30 days in a Super Size Me documentary format. At the end of it, you had a lot of federal police breaking into dispensaries, seizing the marijuana and taking their tools to conduct business (computers, safes, log books ect) as it's still illegal throughout the US. Having said that, I was in San Francisco recently and they smoke like chimneys out there, I got some funny looks when I didn't see the relevance of it being 4.20pm.
