    Basically, on reading the new TOS, if publishers do not have a transparent privacy policy that users can see...stating cookies and/or web beacons may be used for tracking, then Google would be able to ban you from Adsense for not following the TOS agreement.

    It is therefore IMPORTANT that anyone who has agreed to the new TOS also updates their site with a suitable privacy policy, otherwise they are breaking the TOS agreement and their adsense account is at risk.

    edit: This part refers to the cookies and web beacons:

    And it simply means that if you don't accept the agreement, Google is likely to terminate your account. It is not really an option, but more along the lines of "Accept the updated TOS or get banned from participating in the program" type of message.

    I am not sure of all the changes, but 3 things might need to be looked at in addition to the privacy policy disclosure:

    Part 5 is a little confusing in the sense that it reads as if we are not able to put ads on websites that we do not own... i.e. revenue sharing sites. However, that contradicts the way Google launched the API to allow developers to incorporate revenue sharing into their applications.

    Part 6 basically means if you have poorly performing websites, it may be better to remove adsense from them as it could put your account at risk. It should help webmasters focus on quality sites that get organic traffic.

    Part 16 is the infamous poor handling of privacy by Google - you basically have to agree to sending personal information to unknown entities and have no idea how those entities will use or abuse the information. It contradicts the privacy policy that users need to add to websites as we cannot give an accurate disclosure of how people using cookies or web beacons might use or abuse information.
