Business Partner Stole My Adsense Account!

Discussion in 'Legal Issues' started by kingbrend, Jan 17, 2008.

So my first mistake was giving him access to my adwords account; which he was paying for, but still.

We had an argument, and parted and he took my adwords and adsense account, disabled my access to both accounts and hasn't been reachable since.

I've contacted Google, but they keep saying I need to talk to my business partner.

Is there anything I can do to get my account back? It has all my personal details on it, money from current adsense websites, my SS#!!

    What can I do?

From what I see the best way is to talk to your business partner and resolve the differences. You are after all partners. If this fail, you may want to try arbitration and the worse case would be litigation. What is the form of cooperation you are having? Is it a limited company or a partnership in case you need to be careful as there may be unlimited liabilities.

If the account was created with your social security number and not a business taxid then you're perfectly justified in filling a police report just like you would with any other stolen property.

It's weird that Google would say you to solve your problem yourself...Isn't it against their TOS that people can't use other people soc sec number and information for their account...

Try contacting him over email and sorting the issue out, if no luck there, do a WHOIS on his domains and try phoning him.

This is why I only do business with myself.

Is it a formal, legal partnership or company or is it just a partnersship agreement based on word of mouth?

We have a contract, but it's nothing major. It doesn't deal with anything like this.

We basically ran on the our word for the past couple years.

I don't know what I can do. I sent Google so many emails now..

Contact google. if they still insist, then ask for a new account because your partner is gone.

    Make-You-Feel-Good Story:
I was never good with forums, but thankfully im a pretty good web designer. Offered a guy to maintain it, made him admin and all, made his own ftp account on my hosting, and all the goods. The forum got pretty big. Went on vacation over the summer for 2 months. Next thing I know, the domain was gone, the files were gone, and the database wiped. I see that it was sold, I contact the owner and he was pissed. My "Partner" had sold the forum for 2000 but kept the database. So basically just the domain and a copy of vbulletin for 2000.

    Online partners suck. PERIOD.

Wow... Ehh I don't know about feel good because I have a forum too and just appointed a new moderator.

It's growing pretty fast now: Threads: 1,922, Posts: 19,274, Members: 1,226, Active Members: 324

About 2k visits a day to the site now...

    But anyway... that's horrible...

I consider my self a very patient person, I can wait a few more days... but since I'm not getting paid anymore, my salary I need adsense! :)

The problem with that is if the old account is not closed out and his partner continues to use it, any earnings will be reported to the IRS on his social security number. Which means he'll be responsible for paying taxes on money his partner makes.

If both Google and your old partner continue to refuse to do anything then I'd consult a lawyer first thing in the morning. You really don't have any other choice. You can't walk away from your adsense account.

he can't get paid anyway because you can't change your billing info and tax ID and what not so it would be in your name and the checks would go to you anyway, but if the info is in his name then technically its his account. So either way your safe im guessing.

Best method to get back your account is by clarifying the situation. If you can't then both you will lose (you can't get the account and he can't get the money as its in your name)

That was another concern of mine... I have the adsense code and I can add it to the sites I need, but... if he can change the bank account details the money is deposited to, what's the point in me trying to use the adsense account.

But if he can't change the details... I think it would be okay for me to use the adsense account, because right now everything is setup to auto deposit in my bank account.

So can he or can he not change my banking details?

    Thanks a bunch!
