This is probably a grey area, but do you see a problem with the ad units being too close to the images...I've heard this can really help CTR but I don't want to erk the almighty Google gods. Yes, this would clearly be an instantly of violating the terms of service. Those images appear directly over the ads, the ads below seem like they are part of the site itself and a directly link to information about the picture. I personally would remove them and find a different ad placement method.
Why don't ask google: http://adsense.blogspot.com/2006/12/ad-and-image-placement-policy.html so it's clear that you're violating the tos, better remove the images or the ads

That is much better and should be fine. I would think it would still get some decent CTR. I would suggest this... 1. Remove the Top 768x60 leaderboard. 2. Float a 300x250 unit on the right in the middle of your content. 3. Write more content to make it flush. Also, remember you can have one more adsense for content unit on this page.
Cool..thanks for the tips. I put the 300x250 and it looks a lot better. I've had pretty good luck in the past with that ad size and placement.

Yeah...thanks I read that page...I feel that there is plenty of separation between the images and my ad blocks...I have space and additional text between the bottom row of photos and the lower ad block...
Google does NOT (not from that blog, anyway) It's "apples and oranges". The site in question has a layout completely different than Google's example. The separation is distinct and greater physically. The images actually serve a purpose other than saying "here I am!!" for the ads. I maintain that the site is within Policies. The owner may wish to verify it and if he does, hopefully he'll post Google's response here.
I did email that page to Google for clarification and this is the response I received...hopefully it will clarify for people with similar pages.
