    That's a load of bull. They don't stand a chance, Google have very deep pockets, and if they can;t win fairly they'll press it on until the other person is sick of fighting.
    This is kinda stupid though and won't make it to court in my opinion.

    Not being familiar with Australian law myself, what if the little guy does win in Australia? Would Google then no longer allow those in Australia to use Google Adsense? Hmmmm.

    What if some one found a link came in the Organic search result is not really relevant to that key word?

    is that going to be another law suite.

    -- I think the individual company who placed the ad is to take the responsibility and not Google alone - (May be both are liable)
