We're all heavily influenced by advertising, but most of it happens at a subconscious level. There was a Derren Brown show where he got two graphic designers, put them in separate rooms, and they both came out half an hour later with the exact same design for an advertisement. It was all down to the effect of advertising in their environment, which they had subconsciously taken in and it had affected their creative decisions.

So I wouldn't be inclined to assign blame to anyone, even though the logos look similar. But it would look bad to continue to use something that looks so derivative. I don't think that changing it would be some kind of admission of defeat or guilt, just good business sense.

I know I hate that..I have a site and some stupid domain squatters went around registering every domain similar to mine, and they're trying to sell it to other people (it already got sold, and I checked it out and it's just a MFA). I even found a full forum post from one of the domain squatters talking about how the domain is going to net him a lot of money because it's so similar to x domain. lol I'm tempted to rain on his parade and just report the site..not to mention that if I trademark my name, he's in serious crap.

You can't copyright a logo, you can register it as a trademark though. :) For what its worth you wouldn't stand a chance as there are too many differences and as the logo is there before any application you have no common law rights either as you haven't used the logo long enough for you to claim a prior right.

    http://www.uspto.gov/web/offices/tac/doc/basic/

    Hope this helps.

Good for you as that's all that counts. Just for your info and to help you in case you didn't know, you can put the letter TM next to your logo if you wish to claim it as unique to you, this is perfectly legal although it doesn't protect you it does put people off. You can't put a R symbol there until you've gone through the complete process. The link I gave above will help and its ALWAYS good to protect your property these days.

    Good luck.

yeah. I guess rob has some headaches with people sharing out mods that he made.

Dave, do what i do. even if you have no intention of using the .co.uk or other extensions, register them anyway just to stop noobs stealing your brand name

is the biduplinks.co.uk a DP member?

Well just to let you know I didn't have to remove the logo because I didn't copy you nor have you trademarked the logo.
