Nofollows are absolutely worthless, and it makes you look petty.

That's what I was looking for as the OP is going round forums posting ads. Didn't want to dupe.

I am not taking any sides, nor defending the name he used, but he can legally use the site name and domain "avivafind.com", even if you took him to court you would not win.

I am taking sides, I'm on the side of the honest person, Have you ever heard of something called the common law right to intellectual property? In a nutshell its where a person has gained enough association to a particular brand name or product that it is readily associated to the owner. Aviva Directory has 100% done this by mass marketing in the field of directories and this can be backed up by hard evidence.

The owner of Aviva Directory doesn't even have to go to Court although that would be the cheapest way, all he has to do is to go to ICAAN or WIPO and make a complaint of registration in bad faith, there are three rules there that all revolve as 'passing off' the idiot who bought the name avivafind and avivadir are using the 'same name' in the 'same market' using even the same frickin script for goodness sake, how much more evidence of bad faith registration and passing off do you need?

I don't want to be rude but you really need to learn the law before giving opinions.

    Take a look here http://www.icann.org/udrp/udrp-policy-24oct99.htm

Now I ain't no lawyer but I know a man who is and he pretty much summed it up...

If you want more details let me know I'll ask Steve from Cantufind Network who is shit hot at IP law.

Thanks for the info Steve, sure it will help a load of victims of this kind of activity.
