    I guess if someone posts "trade secrets" on your site, you have been requested to remove them and you refuse - I can see reasonable grounds for a law suit.

    However in this case it is pretty uncertain what actually happened. I guess time will tell.

    Personally I am awaiting the political backlash against blogs. If political blogs prove to be an effective political tool (I think they are and will be) things will get messy.

    I've been following this for a few days. I don't think TP will come out of it so well but they should get lots of publicity and they do say that there is no such thing as 'bad publicity', right?

    This is a truely smart move by traffic power. They have a good marketing dept.

    They dont have a shot in hell of winning this lawsuit but I can guarentee there business is up about 9012313%

    Also Aaron Wall's book sales are probably up quite a bit too.

    Both of them are probably scratching there heads wondering why they didnt come up with this earlier =P

    Regardless of whether he decides to drop the content, I find it really amusing that googling 1p (traffic power's *new* name), seobook beat them to number 1 spot! Not only that but the title is Beware of 1P.com!! Thats gotta seriously p*ss them off!!

    Google Traffic Power and look at the links... that's not good publicity for Traffic Power/1P at all, but it certainly is for Aaron Wall.

    It may increase backlinks to Traffic Power but I don't think it's going to help their business at all. If they had been smarter, they'd have let it die and hope people would forget or not assictae the new name with the old debacle. Then again, if they'd been smarter, they wouldn't have screwed it all up in the first place...

    I don't see Traffic Power winning this one.

    It's really interesting follow-on from a court case we had in New Zealand where a high profile bastard got briefly got name suppression but the blogs were buzzing with who it might be. Then when Capill was eventually named bloggers were commenting on the case and his lawyers came out and threatened to sue bloggers who "defamed" a man who was, by his own actions, un-defamable!

    Some of the big questions were
    1. do you have to comply by the laws where your blog is read?
    2. do you have to comply by the laws where your blog is hosted (and do you actually know)?
    3. Are you responsible for all the site content and therefore do you have to ensure that the people who comment on your site comply with the law?
    For forum owners that becomes a bigger issue as they can't possibly read every post on every thread and ensure that the site is totally sanitary.

    But #1 is actually the really tricky one which I haven't seen a good analysis of. If I post from New Zealand on an American forum and it's read in Saudi am I liable under the laws of all 3 countries?

    An interesting, related, prosecution in our courts this week: Webmaster's porn defence fails and Porn man's sentence an affront, says group. This case might be porn, but it's still related to content produced by one group and objected to by another, with a legal remedy available.

    Ok I see what you are saying. I guess I have never tried to sell myself. That is a good point.

    Each time a site I have has been sued or got a c&d that made headlines it was huge bonus for me in traffic/income/links.

    But I am used to services not people...

    I mean in my example of paris hilton.... nobody ever heard of her until the porn video (the first one).

    I do understand what your saying though and no I would not hire them to run my busienss however I would hire them in a minute to promote my products. In fact I tried to get paris hilton to endorse one of my sites on video but she wouldnt ;)
