    You are correct, he's removed the credits, he's been contacted and advised to put them back up or remove the theme. :mad:

    No offense, and I don't by any means agree with what the op did, but don't you guys think we should atleast wait to hear his side of the story and/or see if he adds the credits back on, before we give him red? It may just be me.

    No, it was wrong to remove them in the first place, regardless if he puts them back, he did wrong and shall suffer the consequences.

    I would be happy to put your credits in my site. As long as you send me your site theme url in order to be sure that first idea was from your site and to put what ever credits you want in my site.
    Of course 9dir.com is not using any theme. As , I believe you can understand, it has many different things that wasn’t in the originally theme that I used. This makes the theme of 9dir.com unique. (For example the flags, the colors, the images, the fonts, the logos and many more).
    Of course the way that you decided to contact me “you have 24 hours to put my credit link back up or remove the theme, failure to comply will result in me filing a complaint with your host and of course, outing what you've done” isn’t the best way. If I had your attitude I could make also some remarks about you. But I don’t , I publish freeware programs and under GNU for many years so I have a developers fellowship attitude.
    So send me your site theme url, I will do the changes and I will consider this episode as past.

    Ok the credits where of, but when you take a design and you change the images the fonts add visual scripts – flags – time – and change fonts add option add sections , this isn’t any more the original theme so no credits are obligated.

    I don’t have problem to add credits, and to change everything again. The thing that made me wondering is this attitude. I believe the matter is settled.

    When you take someone else's design and change a few elements and then add something unique of your own doesn't change the fact that it's now a derivative work and infringes on the intellectual property rights of the original works author.

    You seem to have a slight misunderstanding of copyright infringement. The author is well within her rights to demand that you replace the attribution or remove their work (in this case a theme) from your site as it violates her intellectual property rights. She is under no obligation to afford you this opportunity and could have proceeded to exercise her intellectual property rights in a totally different manner.

    They are also within their right to file a DMCA notice with your host and have access to the offending content disabled without providing any prior notice to you, or affording you the opportunity to correct the error.

    His 'side of the story' made me feel even better about giving red. Had he downloaded the theme elsewhere and was able to show the credits now there I may have felt bad.

    According to him you can take Windows from Microsoft, edit the background and hey it's not windows anymore! :D

    BTW anon how many members here are on crack to give you green! :eek:

    I still can’t understand what are you speaking about. A simple private notice would do the job without all these. Anyhow I am working in a new design. You write a lot about DMCA and all of that, but I wrote about a directory. No need of angry messages, the final point is that you made me to want to make the design of 9dir real better. This is a good thing and thank you.

    the point is you used some one else's work without giving due credit. changing a couple of elements doesn't make it your work. credit should still be given. :rolleyes:
