    you can sue him only if he is using your brand name otherwise every one has legal right to do any business

    You don't own any copyright for the menus right, you own the copyright for your brand. That's competition. Tomorrow morning you could have a new restaurant in front of yours. Don't be amazed because people are desperate when it comes to money. Everybody want's to kill the others business and become millionaire. I would advise to play smart and have something more than he has ( a nice website, some coupons during week, a free coffee Saturday and Sunday's mornings) and you will see that people will come where they are well treated. One more thing work lit bit at your prices - now that this guy appeared low your prices because dumping means more customers!

    Hi, were you able secure an employment contract for that person you fired? I hope you had an employment contract and it is clearly stated that trades secret should not be divulged or copied. If you have contract, then you have a strong case against that person.

    If none, a sound advise from your local lawyers may help.

    think how you can do better than him now...
    add more reciepes, something exciting...do internet marketing more than he can imagine...
    and tell him ...who is the boss!

    This but i'd recommend you put in your contracts from now on they aren't allowed to start up their own restaurant if they leave for at least 2 years.
