It won't necessarily get penalised. If google penalised every website with duplicate content we wouldn't have much left. It's a gamble... google might or night not penalise it. In one of my niches someone copied my website word for word and we both haven't been penalised and it's been 2 years... I wish his site would though. I just left my site the way it is because it's a shitty site anyways.

Either way duplicate content is a stupid idea.

Which URL had the content first? Google will typically penalize the site the posted the content second. Duplicate content isn't bad in itself or else there would be no way to syndicate content. If you want one particular site to have credit as the originator then you need to make sure that that site published first.

Google has said over a long period, duplicate content issues are seldom a punishment. It is all the more about Google knowing which page they ought to rank and which page they ought not. Google would like to demonstrate the same substance to searchers for the same question.

It's not the problem they have both the same content.. If Google decided to penalize one of your websites, it would be important which one was indexed first (for this content!). But don't be so afraid, as for example if we copy a huff post on thousands of blogs, then they should be ALL penalized... I don't think so! ;)
