    By policy it says that it isn't allowed but this site doesn't have problem (maybe they have some deal with adsense because they have millions of visitors)

    1. I can not see them in pop-ups on that site
    2. They could be breaking the policy, in which case you can report them
    3. They could be a premium publisher in which case they can negotiate their own terms of conditions and Google permitted in their case

    I have seen small sites using modal dialogs with adsense..
    It is really against TOS. Once, I asked this to google, via google groups but never got an official answer..
    Well, seems I am not a premium publisher.

    You should avoid it.
    Pop-Up ads working with Premium Publisher or Large Scale level.
    Unintentionally Click on Ads chance is higher in Pop-Up. Which is against the TC's of Adsense.
