The best way to get rid of it is by kindly ask the webmaster to remove it... But you can always use the disavow tool too! ;)

IMHO, before getting to this question is good to not MAKE them at all (links). Just think,...we spent time BUILDING links...and after that we must spend time to check and identify which one of them are not good, and after that we use tools like disavow tools and benevolently participate to Google's case studies on theme "how many spammers we have around..."

Instead of this, i think we can use this time in creating quality content and offering to people really what they need.
    Thanks!

For negative backlinks you need to use Disavow Tool from Google.
For double content you must go at www.dmca.com

    1. use backlink tools like ahrefs.com, google webmaster tools, bing webmaster, opensiteexplorer and any other source that can provide you with the backlinks data.

    2. Once you have all the backlink data with you, identify the links that could be harmful and considered to be spam.

    3. Contact the website owner by email and phone to remove those backlinks to your website.

    4. The links that you are not able to remove, submit them for Disavow and then sent a reconsideration request to Google using Google webmasters tool!

    Hope this helps!

You can use Disavow Tool from Google but there are other search engines like Yahoo, Bing etc. that do not use Disavow.
