I want to know that he has put same design and same content on both of the domains. And i think he going to be penalized by the Google because of this very soon. One site is coming on the Google while other is not and this is the main problem. i am thinking to use conical tag on the other website. But i am not sure that i will be sufficient. please tell me what i can do to make both working on the google.

You should change ONLY content! You can have the same design in 500 pages without any problems (you want a proof -> Take a look at blogger and wordpress blogs and you can find many many similar blog designs!)
