Discussion in 'Legal Issues' started by emptyhall, Aug 1, 2013.

    Greetings and salutations everybody...

got a quick question about legal issues regarding of building a porn search engine website.
Basically I 'm planning to create a website where there would be porn thumbnails displayed on the page which would point to the original video when clicked on for example like it is done on nudevista.com website. I just want to know if there will be any legal issues about building such website..? and any pitfalls I should be aware of...

    Thanks in advance...

You may have a problem, the thumbnail images are copyrighted.

u will be effectively scraping the sites of copyrighted materials, which yes is bad

u'r better off investigating using the affiliate programs offered by *most* programs and finding programs that offer rss feeds / tgp feeds for their affiliates, whithin those feeds there's typically thumbs available you can then index/search against

u'r toughest bet's always going to be adding meaningful meta data to all that media ...

LOL ... um yes ... and while I'm sure like everyone else on the forum your very wealth and handsome ... u ain't Google ... (** added ** and a few years ago, I think it was vivid or private did actually win a case against google to have their content removed from ig G's Images search) and I know personally a lot of the big program owners who are *very* wealthy and will sue, aggressively, to protect their content

aint personal but that industry segment, particularly the big guy's, have been through years of having their content ripped off and will stomp out businesses trying to benefit from their hard work ...

like I said they typically provide feeds to affiliates u can just use them and not cross that line

Actually, it was Perfect 10 that sued to have their results removed from Google images.

I was not suggesting that I think either what Google or what he proposes to do is a good idea or legal, I was just pointing out that scraping and indexing copyrighted material is what Google does. :D

There is no any rule against copyrights on pornography sharing or searching on web.
Thing is - A porn star doing movies for 10 Films and 6 Camera Mans per day. So basically Porn Starts signed a document called NOC (No Objection Certificate) to distributes the film.

And now when a website like Bangbros Inc relishing that on net for free (2 mints video or 10 pictures) - They automatically signed-up for un-written agreement of NOC.

So basically you can easily shared or store or put in your search or what ever you like to do with those pictures and movies. There will be no OBJECTION from Bangbros or anyone else.

SO making searching engine on porn is not an issue. :)

I just want to make it so that when user clicks on either thumbnail or link they would be redirected to the porn tube site (like xvideos.com) pointing to the video and they would watch it there and also those thumbnails would be stored in a different server, meaning I will not be hotlinking them. Could I still face some legal issues if I go about like this..?

I'd be high tailing it to a real lawyer who knows about online and international law.

Technically you should have a warning if graphic images are going to be displayed and the requirements may change country to country - so you need to know, as a publisher, what your responsibilities are.

I do know that Google have no such warnings on their image search and you can save their images without going through to the website so it's naive to suggest that you are just passing traffic through. (FWIW, imagine being a 15yo boy with a shared image stream on your phone when your mother decides to show a photo to a friend and up pops lots and lots of Katy Perry porn!)

If you're that 15 year old boy, you'll probably learn something.
    1. NEVER, EVER share ANYTHING with a parent.
    2. IF you do share things with parents, make sure it's not your own, and that they're cool
    3. NEVER, EVER have stuff like that on publicly available streams/folders/shares
    4. LEARN TO INTERNET!

    :D
