Is this Against Adsense ToS?

    Quick question, my site gets about %10 to %15 CTR and I was wondering if this is still against Adsense ToS, even though I mentioned "Sponsored Links" right above the ad.

    Well to be honest it's still aggressive having the adsense placement like that, I'm not really sure if it's alright.

    I already have the 3rd ad in the header on the right side of the logo, can't be seen in that screen shot.
    But I was asking if it's better the way I added it now.

    I have a very similar design like: http://www.friv.org/game/1545/play_match_monsters.html
    And he has been running adsense like that for quite a while now, without any problems, and has over 1.5k visitors online constantly.
    To be honest, I'm a bit anxious to put adsense like that, without specifying "Sponsored Links" or "Advertisements" as it might be classified as misleading for visitors.

    the second one might be people trying to download the game, so its not your fualt its adsense for putting that particular advert there!
