Some guy uploaded a movie trailer of myn is this allowed?

    Have you checked with the movie copies to confirmed that they really don't that their trailers have been uploaded and edited ? Or are you merely making an assumption to satisfy yourself ?

    Well it speaks for itself. Youtube has thousands of trailers uploaded by different users. And yet they allow it! (For Years)

    Can't see the big problem in this. In fact i might start doing it myself.

    Didn't you read my earlier post with all the press release from Youtube which talks about partnerships with the various studios to host movie clips and trailers on Youtube.

    Without those partnerships, do you think they would be able to do what they do without legal consequences ?

    If partnership wasn't a problem then why have all the partnerships and agreements in the first place ?

    Do what you want, just be prepared to get Cease and Desist letters when you get popular.

    Trailers are still copyright of the owners and as such you still need to get explicit permission to use it.

    When you view trailers on Quicktime or the Copyright owners website do you see a 'download trailer' option because I don't. If you use some other means to rip the stream, it does not make it legal to do so.

    If you go to Sony Pictures website where the trailers are http://www.sonypictures.com/movies/index.html , you will see the Terms of Service link http://www.sonypictures.com/corp/tos.html which reads

    Apple has the similiar terms on their website http://www.apple.com/legal/terms/site.html

    Your missing the point though. Thousands of users have been uploading duplicate movie trailers for a long time. Nothing has happened.

    Then please explain that?

    Look it is really up to you, if you do, you do and if you don't, you don't - it's really that simple.

    10000s of users have been banned also for infringements, just don't grow attached to your videos or profile, and if you're using the videos on your site - get ready to replace them when your account is deleted, one way to avoid the pitfalls and dilemas of account suspension is to have multiple accounts.

    You have asked if uploading the movie trailer was allowed and you are getting the correct legal answers, so don't panic or get your knickers in a twist - make the decision and act on it.

    He already has! There are agreements in place that allow them to do so. On YouTube, considering they allow anyone to upload content... In order to be in the safe-zone, and to continue to allow them to do so, they have to arrange the agreements for the users (which they have done / do).

    I think the OP has personally edited a movie trailer that doesn't belong to him which means he incorporates somewhat his own idea into the trailer. Now theres someone else copying the OP version of the trailer. OP wants to know if he can do something about it. Is that correct?

    I believe theres not much you can do because its not your trailer to begin with although you did personally edit it.

    Youtube was a legal nightmare for Google until they had to reach for a settlement with the various numbers of copyright holders. Search the web and you should find news about that.

    Best to just place a link to the copyright owner site then to add the trailer in your video podcast unless you have explicit permission to do so.
