    The trademark won't be pulled from either. You can have the same company name that does things in different industries. Googles will just have to make a case that Google is targeting children specifically, which I think would be hard to do.

    If Google *is* found by a court to be targeting children, most likely they will simply settle with Googles and give them a sum of money.

    That's what happened when Apple started getting into the music business with iTunes, iPod, etc. It paid a fee to a company called "Apple" that was in the music business.

    One would think that the goal is not publicity but simple cash. With Google getting ready for its IPO, doubtless many will feel that the company will be particularly susceptible to buying its way out of any suits, however ultimately valueless to the prosecutors thereof, on the ground that they will want to look squeaky clean at IPO time. Whether that reasoning is sound remains to be seen.

    One critical question would be the date of Google's own trademark or service-mark filing. Another would be the precise nature of the activities of Googles, and the nature of the activity they claim infringes. The basic question, which can be overlain by complex legalistic hassling, is always the reasonable likelihood that the defendant's actions can confuse a third party into confounding the two entities, and thus take away business rightfully belonging to the plaintiff.

    For myself, I cannot imagine any activity of Google that would cause present or potential customers of Googles to think they are dealing with Googles, but that's a fact-driven matter.

    Bottom line is this one won't cost Google a dime, as long as they do not directly compete with this Googles.com outfit in their marketplaces and product lines.

    Damm I called one of my best friends in high school "Goo Goo" and the nickname stuck on him cus his real name was "Greg Gulka".

    Does that mean I can sue Google too, I would like to, but I think my claim would have to be very strong.

    I looked for the domain www.googoo.com and it was taken already by a candy company, can I sue them since I named my buddy "GOO GOO" in high school?

    If these guys do beat Google in a longshot lawsuit and force Google to get a new name, I have one for sale or for development for anyone with some money to invest.

    The name is www.GOOSPY.com I think it would be a great name for Google if they lose their rights to Google. :D

    Well guy's nothing against you but I went back to real work, so I ain't looking at a screen all day any more, I need to make something called money until I get a windfall.

    I want to keep what I have instead of losing everything, so I had to go back to working for a living, too bad for me, welcome to the real world, the recession since 2000 has killed my regular business.

    So I may go back into screen printing full time (working for my old partner).

    I won't forget about the online crap, but until it can provide a income I have to work for a living so mommy does not have to support me!

    Change is good, or (change is forced upon some of us in a downturn) in a downturn in the economy if your business suffers, get a fricking real job.

    You know Bob, "Shit Happens" made a lot of money, so did the SmileFace, you know that little round yellow face.

    You have a hell of an idea here. Really. Now I could sell shirts on my website, now all we need is about 10 grand for the shirts, art and screens.

    The question is would you sue us since you came up with the idea.

    Who would own the copywrites, those sorts of things.

    Great thought Bob, now I know why you have a MBA and I don't, really I am not smart enough to get one anywho.

    The only future I may have with my limited mental capacity would be as a coder like Shawn. :eek:

    SE, I have to go out and make a few bucks until ComparCapital.com approves my venture funding, I may be waiting for a while.

    Until this seed money is approved I am going back to working for another company (my old partner) to keep my head above water.

    As far as the Googles vs Google trademark issue, I have heard through the grapevine that Google in fact did put the Google trademark on childrens product lines.

    So this company may have some kind of claim against Google.

    I doubt they will make Google change names but will force some sort of agreement with them.

    New names just in case they do beat Google could be:

    1) GOODGLE.com

    2) GooGeeks.com

    3) Gooyear.com in case they want to make tires down the road.

    4) GooGooGirls.com in case they want to diversify into the nightclub business :cool:
