How do Warez sites avoid copyright infringements

Discussion in 'Legal Issues' started by Nyte, Sep 9, 2010.

Hey guys, how do sites like warez-bb.org keep functioning and operating even though they are indirectly distributing movies, songs and licensed apps.

I've been pondering on this for a while now, then we got other sites such as anime sites and music sites that get DMCA notices every so often.

    Thanks.

Get a private offshore server and you'll be just fine - DMCA notices will come one after another but who cares .. they don't know whom they are sending them :D

Because they're runned by organised criminals that you couldn't even touch if you tried. It's an impossible game of cat and mouse, one which companies lose. There's a lot of money to be made on the internet and that attracts organised criminals and not just some spotty kid in his mums back bedroom.

They put their servers in countries where copyright laws are non-existent or dysfunctional.

Does the site you mention actually carry the copyrighted files? If they are just linking to them on other sites like Rapidshare, then they aren't actually hosting the files.

You are just as liable for linking, then you are hosting. Why do you think hosts do not allow linkto sites?
as they do not want to be sued...You are just as guilty, maybe less, but guilty none the less...
without linking sites, then warez would go down big time. Thats sort of lame to think you are
not guilty just because you linkto and not actual host the warez...lamo to think otherwise.

The administrators of such sites usually divulge in offshore hosting, avoid using legit personal details and generally don't give a damn. Such websites will be around for good, atleast whilst the internet remains functional.

They host the website in countries where there're no laws against copyrights, such as the netherlands, norway, sweden, russia, romania and so on.

The difference is between linking and hosting. Hosting is illegal in most countries, but linking is safe in many countries. It depends on the laws of the country.

Sharing information is not illegal until it's people uploading someones work. File sharing doesn't mean illegal it's a slang term for illegal activities.

Well if server is in the NL and the admin/webmaster is in the US can't the guy still get busted?

How does a webmaster hide himself?
