Someone just copied our whole company site. What action should we take?

    Hi,

    we own a webhosting company which is registered under licensed in my country.
    today just 30 min ago i got visitor notification from different site, i look to my im and found that , the visitor alert is coming from

    http://extremew.net/hosting

    who simple riped our whole site.

    i made an ip trace here : http://www.ip-adress.com/ip_tracer/extremew.net

    and found that server is in Germany. ip: 212.95.39.63

    checked the domain whois: http://who.is/whois/extremew.net/

    domain registered to :
    TomislavLazarevic
    Tomislav Lazarevic (Email : )

    Pozega
    Zlatiborski,31210
    RS
    Tel. +381.63271639

    Now what legal action can we take against it.

    **i have already notified NetDirect about the issue.

    More info about the ripper: i am getting the fraud persons visitor IP: 109.93.101.153, Country: Serbia, City: Belgrade.

    DMCA can help you up some minor charges but will blow the site away in some days

    Well, From Your part, Kindly Leave him a Mail In a Moderate Manner telling all this and kindly ask him to remove those whole rip.

    Wait for his reply, If he seems negative, You can File a DCMA Case and Ask The Hoster to Suspend the account with no BAckup Left.

    Or you can contact a lawyer that is specialized in internet fraud

    I toked 2 minutes from my precious time and find these 2 :

    Thanks bro. I just send him an email asking to remove those file/materials which is intellectual property of our company. also made cc to netdirect support dept.

    Lets see if he give any reply or not.

    UPDATE ** The ripper changed most of the content to his language also changed the menu and some details.

    Well, Now change your talking mode.. Make it authoritative. Tell them if you keep the stuff in your server again, you will be legally put into a case and your host will be forced to be suspended.

    And wait for the changes :)

    And next, File a Case Legally Or Using DCMA :)

    excuse me about how does DMCA come into play on a server in Germany and and guy in Serbia:confused:

    @OP your best bet is netdirect , mail them at abuse and report his server , they will take action themselves .

    and yeah from experience DO NOT send a DMCA to netdirect they hate it , and you will burn your only chance !!

    how does a act contact a server owner !! , you do realize DMCA is a American act and netdirect is a German d.c ,and nobody even knows where OP is from !! netdriect which really hates it when when some one even sends them a DMCA notice by mistake !! OP 's best chance is to explain to netdirect i know that d.c and they will take action themselves .

    just mail them at abuse and give full details.

    I really dont think you can do anything. hes in a different country why would USA be able to do anything there? hmmm im doubtful...

    anyways who cares if he steals your site? just get more traffic than him and you'll do fine.. its the content and service that matters anyways..

    Cyberlaw is unique across different countries. It is hard to prosecute anyone from countries which doesn't have strict laws. However this comes under copyright infringement and brand misuse. You can complaint to the domain registrar, host or whoever is supporting the site. Good luck to you
