Questiosn about child pornography laws in the US

Discussion in 'Legal Issues' started by freebullets, Dec 10, 2009.

What are the laws regarding child pornography in the US?

Is it illegal to possess pictures of non-nude underage models in provocative positions?

Is it illegal to possess pictures of censored underage models?

Is it illegal to possess pictures of drawn models that look underage (lolicon)?

FreeBullets, I would HIGHLY recommend that you stay clear of anything that has to do with those three.
Otherwise, you could land yourself into a heap of trouble.

I'd appreciate answers to my questions and not some threatening warnings.

    1) Depends on how sexual the pose is. An underage model that has a sexual context can get you in jail if the point is the sexual context (and not some art context like in a movie).
    2) Depends on the reason for the possession really and how you obtained it. A news article can have a censored version. If you have loads of it most likely they will not consider that legal.
    3) US allows virtual child porn. However, it can be considered obscene by community standards which can get you into trouble. I would host virtual child porn from Japan which has a more relaxed viewpoint on it.

    Or don't live in Iowa...

What is all this talk about this obscenity represent? It is not a subject worth discussing and your question is definitely out of line in my opinion!

Why would you even want to know this information? Isn't it obvious? What a sick SOB.

You don't DESERVE answers to this question pal! If you cannot conversation about something that has to do with anything other than abusing children in some form, then maybe you should find another forum that is more into your trash.

That's my opinion and I don't care what you "want". I can voice my opinion and that is what it is.

Any sexually explicit content depicting persons under the age of 18 is illegal. The illegality of such content is not necessarily limited to photos of actual human beings either. It has also included drawings and even text stories.

The answer to your other questions (as creepy as they make you seem for even asking them) depends on the definition of "sexually explicit", which in turn depends on community standards. In other words if 74-year-old Beatrice is on your jury and shown the content you are asking about, how confident are you that she sides in your favor?

The answer to your question is it is illegal and people get paid to spend all day looking for people like you to track down and put in jail where other inmates can knock the crap out of you for fun.

That not a "warning" just the way it is.

And they can and will still track you down in another country.

Most people in prison are in on life sentences or are close to getting out in most cases. They won't have the time if there on a life sentence because they're usually doing 23/1 everyday and are watched very closely. If someone is about to get out they wouldn't risk it on someone else they'd just let them sit in prison. You might get beat up in prison, but the United states prisons are pretty safe to be honest.

It's very illegal in the United States. It's not that it's just illegal either. If you ever do get released from prison you'll be watched all the time and have to be a registered sex offender. You'll have trouble living and finding work. I don't know I just don't understand why you'd want to be in a child porn niche anyways. It's not worth it and most people don't find underage women attractive. They find it sickening and would report you in an instant to the FBI and other child protection services.

Porn niches are too big anyways. It's very hard to get into it since porn is the largest niche on the internet. Even if you do legal porn it still takes a ton of work because you have to always prove they are over a certain age. I believe it varies from state to state from 18 or 21 that is the legal age for porn. I'm not totally sure I don't even want to get into a porn niche anyways as it wouldn't be worth it and I only watch porn to relieve stress.

Final conclusion: I suggest you find a different niche and stay away from porn all together and don't even watch child porn as it's disgusting, but you do what you want to and don't come crying to us when your facing a few years in the pen. Good luck

Kiddie porn, and any one else that messes with kids, are loathed by the most vicious of convicts. You obviously don't understand how the prisons work. You really think the guards are going to break something up right away? Please, please, please, I beg of you, do not speak on matters you don't actually understand. It's people like you that SPAM legal discusssion threads with pointless advice.

People die in prison every day from the actions of another inmate. Do you know all the different items that a shank can be made of? Maybe if you would have spent a little time working a jail you'd understand a little more.

People that are in jail because of messing with kids, and kiddie porn, are lucky if they don't get beat up daily, and possibly killed.

I never said I was an expert. I was just telling him what was going to happen after he got released.

It can happen in prison that you will be attacked, but it's not always the case. Prisons aren't perfect either, so it's a whole different topic that I do not wish to discuss because I never plan on being in prison.

And it's not so much the state to state law for 18-21. That's actually for viewing porn. You can pose in porn at 18.

And a little hint, most people on life sentances aren't on a 23/1 they are in general population until they prove themselves to have the inability to work and play well with others (besides the whole killing thing ;) )

And sorry if I came off as snapping at you. It's just this section of the forum is rampant with people giving bad legal advise on things they have absolutely no understanding on, and I had just read like 12 different threads with multiple posts like that, my patience was wearing thin ;)

Yea, but most of them can't control themselves if there in on a life sentence. They have no reason to. Some find god and all that, but it seems rare nowadays.

I agree it's astounding that people will not do their research and instead rely on advice that may be legitimate or hack advice. For something as serious as what the poster is talking about, I personally would not feel comfortable to base future action on some posts by a third party. Johnbillybobjoe from DP xyz forum, is not going to be the one representing you in court should you have a problem.

There is a reason why pornography company's have lawyers on retainer and discuss instances with them.

The legal system is highly complex and it varies from one state to another. And especially from country to country.

I could not agree more with you on this statement.
I am by no means a legal expert but MOST of the answers given in this legal section are posted by people that dont know their A?? from their Elbow.

I feel sorry for those that ask a genuine question and follow the idiotic advice given by these people that dont know the correct answer but are so intent on boosting their posing count, that they will give any old BS as an answer anyway.

No one was giving you "threatening warnings", although I think you're asking for it.

Ultimately you need to do your own research for your own state and not rely on people in other states and countries in some cases to advise you on something as serious as this.

If you plan on setting up a website with this kind of content (the only reason I can imagine you're asking this in a webmaster forum) then I think you ought to be aware that it isn't only jail you need to be afraid of but parents, vigilantes and of course anyone who knows where you live.

If you are asking for a non perverted reason then I'd like to hear it because right now I can't imagine just what that could be.

I saw some sites with some of the topics that I stated in my first post and was wondering if I would be able to report them. I don't support any of it at all, but I also wanted to know a little more about the laws in this country. God forbid something happened to my 3 year old daughter.
