Wallpaper Sites Legal?

    Are movie wallpaper/celebrity wallpaper sites legal?
    Can we get sued for having movie wallpapers on our sites?

    Also, would you display your adsense ads on those sites?

    They are not legal unless you have permission from the copyright holder to distribute them - otherwise it is copyright infringement and cause for your adsense account to be terminated. I would say the vast majority of wallpaper sites are infringing upon copyrights.

    That means those wallpaper sites are not legal, but there are way too many of them and I am guessing all of them are illegal?

    They are almost in all cases illegal unless you are properly licensing the graphics that are in them.

    I seen a site using GNU/creative commons licence, and they are completely legal, but the naked celebs etc sites are using unlicenced material, although generally un-enforced, still definately illegal

    I had a wallpaper on one of my sites that used a picture of a cd cover on it and I was told that I had to take it down or I would be sued. This was 4 years ago. Very illegal.

    "Royalty free" does not mean free to use. It refers to a type of contract between the copyright holder and user. You still need to get permission for usage.

    tread carefully. Copyright protection forces now carry guns... ask some student over in Florida university when their dorm got raided to shut down a site that had copy right materials on it.

    Just to throw this out, I probably host hundreds of them on my boxes and I have never seen a DMCA or other copyright complaint go by me.

    That's not saying that those images are not copyrighted. I feel they are.

    I do know that if you load them into some type of program that's going to go harm like some sort of spyware, they'll get after you.

    I think if you do it tasteful, link back to where you got the images, linked back to where they are on the web, etc., most folks will see it as marketing and not a copyright violation.

    All Copyrights belong to the original owner. PERIOD! That'll i think deter them from bothering you in most cases :p
