I would think not, however even if the lines are blurry legally, it may be against the terms you agreed to with your host.

As far as i know if the files aren't on your server you can't get in any trouble but as markb sad you need to see the terms of you host, but even if they don't mention it that doesn't make it legal.

Most hosts don't allow warez. I've seen hosts suspending accounts without warning because of warez. And the guy just had a few files hosted on the server.

Most hosts don't allow it. Check your hosts TOS / AUP.

t-warez.com is a massive warez site. They hardly have downtime or suspensions.

Most warez sites that stay up are often hosted offshore in the east.

As the forum grows, the boundaries between legal and illegal activities will begin to blur. Why do you want to host a warez forum anyway? You are just setting a website up to fail. You will be funding warez/pirating indirectly. Even if you are only providing links, the companies who are being hit by pirating will take you on. Find a topic you like and build a website up on that topic as well, you'll find it much more rewarding.
