Again, that host is GONE - im the new owner - saying that simply slams the door in my face. I have bought neocpanel to give its clients a second chance - where they can rest assured that their files will remain intact and never touched.

This is one reason why if I go with hosting I now wait at least for them to be in operation for 1 year and do extensive search's online for reviews of their hosting and ask for the uptime log of the server I am going to be hosted upon and email a small sample of people using their name servers.

To strike back, there are places where you can find all the whois information on the websites they have tied to their name servers. Post on ripoffreport.com a complaint and email those people that are hosting with them. I will say this and it is important, if you email those people Don't tell them in the email what the company did to you, I repeat don't tell them, just tell them your looking for reviews and then give them the website address instead. As then you can not get counter sued for defamation(sp), but you can ask them to go and post about their experience with that certain web hosting. As ripoffreport will never take down a complaint on a web host and since it has great pagerank when doing a google search on a host the complaint is usually within the top 10 results. and you can't be sued for stating your option and they can't say you told the others directly about the company being bad.

Now as for the person running the show. There is a php script that will show the person an image if you send them a email/private message on a forum, but collect information on them such as the IP. With that you can narrow down which country they live in at least, if the who information is blocked. So, you can at least know if you can take it further legally, to file a small claims under $5000 in the united states it is something like $20-$70 and you have to file it in the state they are running the business and you can ask for the filing fee's so it will not cost you much else other then gas to go to court. Side note, yes if they don't do business in your state you have to file in the state they do business. (this is if they live in the good ol USA). As I am starting to see more and more web hosting scam's done by non USA people and that could spell trouble and hard to take to court. If they are using private whois information. You can email the domains register and tell them they did you wrong and you need the address to be able to take them to court and/or contact the place they are renting the server from.

About the person running the show. If the person running the show is a minor you still have some legal recourse as they did not disclose that information when you made the contract with their company and can still be held liable for all legal actions as fraud and falsifying information, but woo is the person that takes a minor to court, because they do have wiggle room and can say the contract is null and void and not be legally responsible. Their parents in some cases can be held responsible for the child's actions as seen with the RIAA cases.

Something else. Since hosting is a virtual service paypal will reject any charge back claims if you go to them. This is why you should always pay through paypal with a credit card instead. And instead of going to paypal to file a claim. Go to the credit card company. Paypal will then give you your money back because it has to deal with the big old bad credit card company and not a small time customer.

Finally, take everything I have said with a grain of salt, because it might sound good or I might be just talking out of my butt.

Yes, once an apology was made. - BUT if you were like he says then YES without any apology.

Why don't you guys just give him his files and databases, etc back and "if" they were shared else where, please contact those site owners and have them removed before someone causes some legal issues which if the customer is correct then he has a right to "sue you".
